在阅读法律英语文本时，经常遇到一些古旧词汇，而这些词汇在现代用于中已经很少用到了。古旧词汇包括古代英语和中世纪英语的词汇，这两个时期从拉丁语、法语和希腊语中借来的外来法律词语70%仍沿用至今。法律人士起草法律文件时依然喜欢使用这些词语，以使法律文件句子显得简练、严谨，更好反映出法律的文体特征。
旧体词多为副词，一般是here，there或者where与in、on、after、of等介词结合构成的复合词。下面本人将学习的古旧词汇使用的笔记整理如下，希望对大家有所帮助。
（一）以here为词根的旧体词
Here的意思是"这里"、"此处"，因此以"here"为词根的旧体词大部分的意思是"此……"、"这……"、"本……"等意思。
1.hereafter，hereinafter，hereunder
这三个词的含义和用法基本一致，翻译为"自此以后"、"此后下文中"。Hereinafter更为正规、语气更重。
2.Herein，hereof，herewith
这三个词的含义和用法基本一致，翻译为"在……中"，但herein是"in this……"（在……之中），一般修饰动词；hereof是"of this……"（……中的），一般修饰名词；herewith是"with this……"（与……一道），一般也修饰名词。
3.Hereby，hereto
Hereby 意思是"by this……"（据此、特此），hereto意思是"related to this……"（与此……有关）。
Hereto最常见的就是the parties hereto agree as follows 意思是"合同双方达成一致意见如下"。
（二）以there为词根的旧体词
There 的意思是"那里"、"那个方面"，因此，以there为此跟的旧体词在汉译的时候都有"那……"、"该……"、"其……"的意思。

（三）以where为词根的旧体词
以where为词根的旧体词常用的就是：whereas和whereby。
1.Whereas
Whereas在法律英语中的意思是"鉴于"、"有鉴于"。
2.Whereby
Whereby 在法律英语中的意思是"凭……"、"据……"。
