（一）if句式

法律文本是由规则、条文组成的，尤其是在立法文本中，一则条文一般包括假定、处理、制裁等三个部分。

 

（二）shall句式及相关的情态动词比较

英文中的情态动词，只有shall，may，must是法律文本中最常见的。关于shall，法律界人士的共识是：shall跟第一人称连用纯粹是将来时的助动词，而will则带有感情色彩；如果shall与第二人称、第三人称一起使用，则表示说话者的意图、允诺、告诫、警告、命令、决心等等。

1.must翻译成“必须”无异议

 

2.May多翻译成“可”

 

3.Shall是法律英语中最常见和最复杂的情态动词

Shall常见的译法有“须”、“应该”或者忽略不译。Shall如同英语中某些情态动词或者助动词，并不一定需要翻译成中文的。

 

 

法律英语中情态动词除了在肯定句中，还会在否定句中规范当事人不可以做什么，最常见的情态动词的否定形式是：shall not，may not，must not，以及相应的变形体：No...shall，no...may，must not。

在英译汉中，情态动词否定形式的句式可以翻译成“某人不得做某事”。

 

 

（三）where引导的定语从句

在法律英语中，where比较典型的用法是where引导条件状语从句，相当于in the case where，通常译为“凡……”或者“如……”。

 

 

（四）常用短语和词组

1.In accordance with 根据……

In accordance with比according to要正式。In accordance with 与pursuant to、under意思一样。

例句1：依照法律服兵役和参加民兵组织是中华人民共和国公民的光荣义务。

翻译：It is honorable duty of citizens of the People’s Republic of China to perform military service and join the militia in accordance with the law.

例句2：上市公司必须按照法律、行政法规的规定，定期公开其财务状况和经营情况，在每会计年度内半年公布一次财务会计报告。

翻译：A listed company shall ，pursuant to the provisions of the relevant laws and administrative regulations， periodically make public its financial and operational conditions. A listed company shall， once every six months in each fiscal year， publish its financial statements.

2.Otherwise 除……以外，以其他……方式

Otherwise 常与前置的unless或者or，还有后置的than连用。

例句：No person shall be held to answer for a capital， or otherwise infamous crime， unless on a presentment or indictment of a Grant Jury， except in cases arising in the land or naval forces， or in the militia， when in actual service in time of war or public danger； nor shall be compelled in any criminal case to be a witness against himself， nor be deprived of life， liberty， or property， without due process of law； nor shall private property be taken for public use without just compensation.

翻译：无论何人，除非根据大陪审团的报告或者起诉书，不得受判处死罪或其他不名誉罪行之审判，但发生在陆、海军中或发生在战时或者出现公共危险时服现役的民兵中的案件，不在此限。任何人不得因同一罪行为而两次遭受生命或者身体的危害；不得在任何刑事案件中被迫自证其罪；不经正当法律程序，不得被剥夺生命、自由或财产。不给予公平赔偿，私有财产不得充作公用。

3.Subject to 根据……规定

在法律英语中，subject to的意思是“受制于”有关条款或者“依照”某些条款办事。

例句：All persons born and naturalized in the United States， and subject to the jurisdiction thereof， are citizens of the United States and of the State wherein they reside.

翻译：凡在合众国出生或者取得合众国国籍并受其管辖的人，均为合众国和其居住州的公民。

4.Without prejudice to 在不损害……的原则（情况）下

Without prejudice to的法律意义是“对法定利益或要求无影响或无损害”，一般翻译为“在不损害……的原则（情况）下”“在……不受影响的情况下”。

例句：If the seller fails to deliver all of the Goods in accordance with the contract on the Delivery Date， without prejudice to the Buyer’s rights for breach of contract， the Buyer may terminate the contract.

翻译：如果卖方未能按照合同的规定在交付日期交付全部货物，则买方可在不损害买方就违约所拥有的权利原则下终止本合同。

5.Provided that 倘若、如果

当provided that 位于句首，相当于if；如果位于句中，前面有一个主句，相当于but，是法律中的“但书”。

例句：This Convention does not prevail over any international agreement which has already been or may be entered into and which contains provisions concerning the matters governed by this Convention， provided that the parties have their places of business in States parties， to such agreement.

翻译：本公约不优于业已缔结或者可能缔结并载有与属于本公约范围内事项有关的条款的任何国际协定，但以双方当事人的营业地均在这种协定的协约国内为限。

6.Notwithstanding 尽管、即使

在法律英语中，Notwithstanding 是连词引导一个名词性短语，出现频率很高的。

例句：This Constitution， and the laws of the United States which shall be made in pursuance thereof； and all treaties made， or which shall be made， under the authority of the United States shall be the supreme law of the land； and the judges in every state shall be bound thereby， anything in the constitution or laws of any state to the contrary notwithstanding.

翻译：本宪法及依据本宪法所指定之合众国法律；以及合众国已经缔结及将要缔结的一切条约，皆为全国之最高法律；每个州的法官都应受其约束，任何一州宪法或者法律中的任何内容与之抵触时，均不得有违这一规定。

7.In respect of 对于……、有关……的

法律英语中，表示一个与某事物相关的概念，一般不会选择使用in connection with， in relation to， with reference to，而是选择用 in respect of。

例句：The Licensee shall， at the request of the Licensor and at the Licensor’s expense， give full cooperation to the Licensor in any action or claim brought or threatened to be brought in respect of the Licensed Trademarks， including joining as a party to any proceedings.

翻译：对于就受许可商标提起或拟就提起的诉讼或索赔，应许可方要求并由许可方支付费用，被许可方应给予许可方充分合作，包括作为当事人参与任何诉讼。

8.For the purpose(s) of 为了，就……而言

如果紧跟着for the purpose of 词组的是某个法律条款的指代编号，通常翻译为“就章、节、条、款而言”；如果此词组根据上下文可以替换为for或者in order to，则翻译为“为了……”。Purpose前面还可有形容词修饰，比如for political purpose，翻译为“为了政治目的”。

例句：For the purpose of any repossession pursuant to Clause 7 Party A or its agent shall be entitled to enter any relevant land or buildings with such transport as may be necessary.

翻译：就根据第7条进行的任何重新占有而言，甲方或其代理有权凭借所需要的交通工具进入相关土地或建筑物。
